Damages

Any damages to the yacht by the charter beyond normal wear and tear are the responsibility of the charterer.

Drugs

The possession, use, sale or distribution of illegal drugs on board any vessel is prohibited. These activities will result in the immediate termination of the charter without a refund of any moneys paid. Repatriation will be at the cost of the charter.

Cancellations

We recommend trip cancellation insurance. Cancellations received 180 days or more are subject to an administrative fee of $500 per person. Cancellations received between 180 days and 60 days are not refundable unless the identical space on the yacht can rebooked and are subject to the $500 per person fee. Cancellations inside of 60 days are non refundable.

Travel Medical Insurance

We require each passenger to have their own travel emergency medical insurance in the event of an emergency.  There are a wide variety of company, credit card and travel policies out there offering coverage.  We suggest a minimum insurance policy that covers medical emergency evacuation and repatriation.

Adding cancellation insurance to your medical insurance is optional, but always recommended. By having ‘all-inclusive’ coverage you do not need to worry about emergencies that can happen any time, any where, before or during your travels. Including the cost of your airfare, as well as your sailing, ensures that you do not have to worry about any unforeseen situations such as having to rush home to a family member or having a tour changed or cancelled because of a natural disaster.

Liability

Custom Sailing Worldwide, LLC  shall not be liable for any loss, injury or damage to person, property or otherwise, in connection with any accommodations, transportation, or other services resulting directly or indirectly from any acts of God, dangers incident to the sea, fire, breakdown of machinery or equipment, acts of government or other authorities, wars whether or not declared, hostilities, civil disturbances, strikes, riots, thefts, pilferages, epidemics, quarantines, medical or customs regulations, defaults, delays or cancellations of or changes to itineraries or schedules, or from any causes resulting from insufficient or improperly issued passports, visas, or other documents. Neither Custom Sailing Worldwide, LLC  nor any of its affiliates or subsidiaries shall be or become liable or responsible for any additional expenses of liability sustained or incurred by the charter guest as a result of any of the aforementioned causes Custom Sailing Worldwide, LLC’s responsibility to passengers carried in vehicles, boats and aircrafts for transfers and excursions is governed by the laws of the respective countries in which the tours take place and no other country. All claims are subject only to the jurisdiction of the courts of the country in which the cause of action arises. The right is reserved to substitute yachts and to alter itineraries. The right is also reserved to cancel the charter prior to departure.  Charters canceled by the charter guest are subject to Custom Sailing Worldwide,LLCs cancellation policy. Custom Sailing Worldwide, LLC. is not responsible or liable for defaults under the control of Custom Sailing Worldwide, LLC. The traveler assumes complete and full responsibility for, and hereby releases Custom Sailing Worldwide, LLC. from any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements for each destination, and all safety and security conditions during the length of the proposed travel. The receipt of your deposit and/or final payment will indicate that you have read these Terms and Conditions, and that you have agreed to them. Prices are subject to change.
